1. Agreement to Terms

By accessing and using NorwayClips, you accept and agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our platform.

2. Description of Service

NorwayClips is a digital marketplace for stock video footage of Norway. We connect content creators (Contributors) with buyers seeking high-quality video content. Our service includes:

• Access to a curated library of Norway video footage
• License management for purchased content
• Secure payment processing through Stripe
• Content delivery and download services
• Contributor upload and earnings management

3. User Accounts

3.1 Registration

To purchase content or contribute footage, you must create an account. You agree to provide accurate, current, and complete information during registration and to update such information as needed.

3.2 Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must immediately notify us of any unauthorized use.

3.3 Account Types

• Buyer Accounts: For purchasing and licensing video content
• Contributor Accounts: For uploading and selling video content (requires application approval)

4. Content Licensing

4.1 License Grant

Upon purchase, you receive a non-exclusive, worldwide license to use the video content according to the license type purchased. License types include:

• Standard License: Suitable for most projects including web, social media, and commercial use
• Extended License: Includes additional rights for resale and unlimited distribution
• Editorial License: For news, commentary, and educational purposes only

4.2 License Restrictions

Unless you have an Extended License, you may not:

• Resell, redistribute, or sublicense the content
• Use content in templates or products for resale
• Register content with copyright offices
• Use content in a defamatory, pornographic, or illegal manner
• Use content to create a competing stock footage service

4.3 Attribution

Attribution is not required but appreciated. Contributors retain copyright to their original work.

5. Purchases and Payments

5.1 Pricing

All prices are listed in Norwegian Kroner (NOK) unless otherwise stated. Prices are subject to change without notice, but changes will not affect orders already placed.

5.2 Payment Processing

Payments are processed securely through Stripe. We do not store your credit card information on our servers. By making a purchase, you agree to Stripe's Terms of Service.

5.3 Refunds

Due to the nature of digital products, all sales are final once content is downloaded. Refunds may be granted at our discretion for:

• Technical issues preventing download
• Significantly mislabeled or misrepresented content
• Duplicate purchases made in error

Refund requests must be submitted within 7 days of purchase to support@norwayclips.com.

6. Contributor Terms

6.1 Content Submission

Contributors must own all rights to submitted content or have proper authorization to license it. By uploading content, you represent and warrant that:

• You own or have rights to all content submitted
• Content does not infringe on third-party rights
• You have obtained all necessary model releases and property permissions
• Content is authentic and filmed in Norway as represented
• Content meets our quality and technical standards

6.2 Content Review

All submitted content undergoes review before approval. We reserve the right to reject any content that:

• Fails quality standards
• Contains offensive or inappropriate material
• Infringes on rights of others
• Is improperly categorized or tagged
• Lacks required documentation (releases, permits)

6.3 Revenue Sharing

Contributors earn royalties on each sale according to their tier level:

• Hobbyist Tier: 50% base royalty + bonuses
• Verified Tier: 60% base royalty + bonuses
• Pro Tier: 70% base royalty + bonuses

Additional bonuses apply for authenticity verification, exclusivity, and sales volume.

6.4 Payouts

Earnings become eligible for payout 30 days after sale (to account for potential refunds). Minimum payout threshold is 500 NOK. Payouts are processed via Stripe Connect, PayPal, or bank transfer.

6.5 Content Removal

Contributors may request content removal at any time. Removal does not affect licenses already granted to buyers.

7. Prohibited Activities

You may not:

• Violate any applicable laws or regulations
• Infringe intellectual property rights
• Upload malicious code or viruses
• Attempt to reverse engineer or circumvent security measures
• Use automated systems (bots, scrapers) without permission
• Manipulate or game the rating/review system
• Submit fraudulent content or claims
• Harass or abuse other users or staff

8. Intellectual Property

The NorwayClips platform, including its design, features, and technology, is protected by copyright, trademark, and other laws. You may not copy, modify, distribute, or create derivative works based on our platform.

9. Privacy and Data

Your use of NorwayClips is also governed by our Privacy Policy. We collect and process personal data as described in that policy, which is incorporated into these Terms by reference.

10. Disclaimers

NorwayClips is provided "as is" and "as available" without warranties of any kind. We do not guarantee that the service will be uninterrupted, secure, or error-free. We are not responsible for:

• Accuracy of content metadata or descriptions
• Actions of contributors or buyers
• Technical issues beyond our control
• Third-party services (payment processors, hosting)

11. Limitation of Liability

To the maximum extent permitted by law, NorwayClips and its operators shall not be liable for indirect, incidental, special, consequential, or punitive damages arising from your use of the service. Our total liability shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless NorwayClips from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your violation of these Terms
• Your violation of any rights of another party
• Content you submit to the platform
• Your use of licensed content

13. Modifications to Terms

We reserve the right to modify these Terms at any time. We will notify users of significant changes via email or platform notice. Continued use after changes constitutes acceptance of the new Terms.

14. Termination

We may suspend or terminate your account at our discretion for violations of these Terms. Upon termination:

• Your access to the platform will be revoked
• Previously granted licenses remain valid
• Unpaid contributor earnings may be forfeited
• You must cease use of our platform and services

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of Norway, without regard to conflict of law principles.

15.2 Arbitration

Any disputes arising from these Terms or use of NorwayClips shall be resolved through binding arbitration in Oslo, Norway, except where prohibited by law.

16. Miscellaneous

16.1 Entire Agreement

These Terms, along with our Privacy Policy and any additional guidelines, constitute the entire agreement between you and NorwayClips.

16.2 Severability

If any provision of these Terms is found invalid or unenforceable, the remaining provisions will continue in full force.

16.3 No Waiver

Our failure to enforce any right or provision does not constitute a waiver of that right or provision.
